General Terms and Conditions with Customer Information for the OnlineShop

1. scope of application
1.1 For the business relationship between Teamevent 030 GmbH, Pappelallee 78/79, 10437 Berlin, Germany (hereinafter referred to as "Seller") and the customer (hereinafter referred to as "Customer"), the following General Terms and Conditions shall apply exclusively in the version valid at the time of the order.
1.2 You can reach our customer service for questions, complaints and objections on weekdays from 10:00 AM to 8:00 PM under the telephone number +49 30 2123 4088 and by e-mail at info@teamevent-030.de.
1.3 A consumer within the meaning of these General Terms and Conditions is any natural person who enters into a legal transaction for a purpose that can predominantly be attributed neither to his commercial nor to his independent professional activity (§ 13 BGB).
1.4 Deviating terms and conditions of the customer shall not be recognised unless the seller expressly agrees to their validity.

2 Offers and service descriptions
2.1 The presentation of the products in the online shop does not constitute a legally binding offer, but an invitation to place an order. Performance descriptions in catalogues as well as on the Seller's websites do not have the character of an assurance or guarantee.
2.2 All offers are valid "while stocks last", unless otherwise stated with the products. Apart from that, errors are excepted.
2.3 The time specifications regarding the duration of the respective events, also on vouchers, serve only as an indication of the period of time you will spend in connection with the respective experience. You may spend the experience with other participants on the relevant event date. There may be waiting times in exceptional cases. The times shown on the websites of Teamevent 030 GmbH are therefore non-binding and may vary.
2.4 Unless otherwise stated, each voucher of Teamevent 030 GmbH can only be used once and cannot be combined with other vouchers! If the service is not used in full, the unused difference will be forfeited. The remaining amount will not be refunded.
2.5 Unless otherwise stated, the voucher of Teamevent 030 GmbH does not necessarily grant the right to use services at a certain time. In this case the voucher will contain information to arrange the time of service provision individually with Teamevent 030 GmbH.
2.6 The duration of the sale of vouchers is, if applicable, limited in time and is individually determined by Teamevent 030 GmbH per offer. After expiry of the time no further purchase is possible.
2.7 Teamevent 030 GmbH is entitled to cancel an order of the customer for which a transaction number has already been assigned (unilateral right of withdrawal) if the customer violates specific conditions set up by the organiser/provider, which were pointed out within the scope of the conditions of participation, or tries to circumvent them (e.g. violation of the deed conditions, violation of resale prohibitions). The declaration of cancellation/withdrawal can also be made impliedly by crediting the amounts paid.
2.8 Group offers for the Laser Game, for the Stag Party Laser Game (JGA-Laergame) and for the Live Escape Game "Operation Underground" cannot be refunded or partially refunded after purchase (e.g. in the event of a reduction in participants on the part of the customer). The purchase of a group offer can only be cancelled within the legally prescribed right of withdrawal (14 days after purchase).

3 Ordering process and conclusion of contract
3.1 The customer can select products from the seller's range without obligation and collect them in a so-called shopping basket by clicking on the "Add to shopping basket" button. The customer can then proceed to the conclusion of the order process within the shopping basket by clicking on the button [Continue to checkout]. 3. 2.
3.2 By clicking the "Buy" button, the customer makes a binding request to purchase the goods in the shopping cart. Before submitting the order, the customer can change and view the data at any time. Necessary details are marked with an asterisk (*).
3.3 The seller then sends the customer an automatic confirmation of receipt by e-mail in which the customer's order is listed again and which the customer can print out using the "Print" function (order confirmation). The automatic confirmation of receipt merely documents that the order of the customer has been received by the seller and does not constitute an acceptance of the application. The purchase contract is only concluded when the seller has sent or handed over the ordered product to the customer within 2 days or has confirmed the dispatch to the customer within 2 days with a second e-mail, express order confirmation or sending of the invoice.
3.4 Should the Seller allow payment in advance, the contract shall be concluded with the provision of the bank details and request for payment. If the payment is not received by the Seller within 10 calendar days after sending the order confirmation, despite the due date, even after a renewed request, the Seller shall withdraw from the contract with the consequence that the order shall lapse and the Seller shall have no obligation to deliver. The order is then completed for the buyer and seller without further consequences. A reservation of the item in the case of advance payments is therefore made for a maximum of 10 calendar days.

4. ticket purchase for the UNDERGROUND YOUNG PEOPLE'S DEPARTMENT product

4.1 When purchasing tickets for the product Underground Stag Party including StripShow, the following separate cancellation conditions apply:

8 days or more = free of charge

less than / equal to 7 days = 150,00 €*

*The fee of € 150.00 is the cost/booking share for the ordered strip show. The strip show is purchased and prepaid by Teamevent 030 GmbH (Underground Lasergame) via an external agency.

5 Prices and shipping costs
5.1 All prices stated on the Seller's website are inclusive of the applicable statutory value added tax.
5.2 In addition to the stated prices, the Seller shall charge shipping costs for delivery. The shipping costs will be clearly communicated to the Buyer on a separate information page and during the ordering process.

6 Delivery, availability of goods
6.1 If advance payment has been agreed, delivery will be made after receipt of the invoice amount.
6.2 If not all ordered products are in stock, the seller is entitled to make partial deliveries at his own expense, insofar as this is reasonable for the customer.
6.3 If the delivery of the goods should fail through the fault of the buyer despite three delivery attempts, the seller can withdraw from the contract. Any payments made will be refunded to the customer without delay.
6.4 If the ordered product is not available because the Seller is not supplied with this product by its supplier through no fault of its own, the Seller may withdraw from the contract. In this case, the Seller will inform the Customer immediately and, if necessary, propose the delivery of a comparable product. If no comparable product is available or if the customer does not wish a comparable product to be delivered, the seller will immediately reimburse the customer for any consideration already paid.
6.5 Customers will be informed about delivery times and delivery restrictions (e.g. restriction of deliveries to certain countries) on a separate information page or within the respective product description.

7. payment modalities
7.1 The customer can choose from the available payment methods within the framework of and before the conclusion of the order process. Customers will be informed about the available means of payment on a separate information page.
7.2 If payment by invoice is possible, payment must be made within 14 days of receipt of the invoice. For all other methods of payment, payment must be made in advance without deduction.
7.3 If third-party providers are commissioned with the payment processing, e.g. Paypal and SOFORT-Überweisung, their general terms and conditions shall apply.
7.4 If the due date for payment is determined by the calendar, the customer is already in default by missing the deadline. In this case, the customer shall pay the statutory default interest.
7.5 The customer's obligation to pay default interest does not preclude the seller from claiming further damages caused by default.
7.6 The customer shall only have a right of set-off if his counterclaims have been legally established or recognised by the seller. The customer may only exercise a right of retention if the claims result from the same contractual relationship.

8. retention of title and resale

8.1 Until full payment, the delivered goods remain the property of the seller.
8.2 The commercial resale of vouchers from Teamevent 030 GmbH is prohibited unless otherwise agreed in writing. Regarding a violation of the aforementioned prohibition Teamevent 030 GmbH reserves all rights and claims, especially the assertion of compensation. For each individual case of violation of the provisions of the aforementioned prohibition and under exclusion of the objection of continuation, the user undertakes to pay a contractual penalty in the amount of 500,- Euro. Teamevent 030 GmbH reserves the right to claim further damages.
Especially the duplication, editing or manipulation of the vouchers is not allowed and will be prosecuted. Teamevent 030 GmbH reserves the right to use the stored data to initiate legal steps in case of justified suspicion of unauthorised duplication. The right of withdrawal is subject to §§ 346 ff. BGB apply to the exclusion of § 350 BGB.

9 Warranty for material defects and guarantee
9.1 The warranty shall be governed by statutory provisions.
9.2 A guarantee only exists for the goods delivered by the seller if this has been expressly given. Customers will be informed of the terms of the warranty before the order process is initiated.

10 Liability
10.1 The following exclusions and limitations of liability shall apply to the Seller's liability for damages, without prejudice to the other statutory requirements for claims.
10.2 The Seller shall be liable without limitation insofar as the cause of the damage is based on intent or gross negligence.
10.3 Furthermore, the Seller shall be liable for the slightly negligent breach of essential obligations, the breach of which jeopardises the achievement of the purpose of the contract, or for the breach of obligations, the fulfilment of which makes the proper performance of the contract possible in the first place and on the observance of which the customer regularly relies. In this case, however, the Seller shall only be liable for the foreseeable damage typical for the contract. The Seller shall not be liable for the slightly negligent breach of obligations other than those referred to in the above sentences.
10.4 The above limitations of liability shall not apply in the event of injury to life, limb or health, for a defect following the assumption of a guarantee for the quality of the product and for fraudulently concealed defects. Liability under the Product Liability Act remains unaffected.
10.5 Insofar as the Seller's liability is excluded or limited, this shall also apply to the personal liability of employees, representatives and vicarious agents.

11 Storage of the text of the contract
11.1 The customer can print out the text of the contract before submitting the order to the seller by using the print function of his browser in the last step of the order process.
11.2 The Seller will also send the Customer an order confirmation with all order data to the e-mail address provided by the Customer. With the order confirmation, the customer will also receive a copy of the General Terms and Conditions together with the cancellation policy and the information on shipping costs as well as delivery and payment terms. If you have registered in our shop, you can view your orders in your profile area. In addition, we store the text of the contract, but do not make it accessible on the Internet.

12 Data protection
12.1 The Seller processes personal data of the Customer for a specific purpose and in accordance with the statutory provisions.
12.2 The personal data provided for the purpose of ordering goods (such as name, e-mail address, address, payment data) shall be used by the Seller to fulfil and process the contract. This data will be treated confidentially and will not be passed on to third parties who are not involved in the ordering, delivery and payment process.
12.3 The customer has the right to receive, upon request and free of charge, information about the personal data stored by the seller about him. In addition, he has the right to have incorrect data corrected, to have his personal data blocked and to have his personal data deleted, provided that there is no legal obligation to retain such data.
12.4 Further information on the type, scope, location and purpose of the collection, processing and use of the required personal data by the Seller can be found in the Privacy Policy.

13 Jurisdiction, Applicable Law, Contractual Language
13.1 The place of jurisdiction and performance is the registered office of the seller (Teamevent 030 GmbH, Westerlandstr.4, 13189 Berlin, Germany) if the customer is a merchant, a legal entity under public law or a special fund under public law.
13.2 The contract language is German.

14 Form of declarations
14.1 Legally relevant declarations and notifications that you have to make to Teamevent 030 GmbH must be made in writing and sent by post to the address Teamevent 030 GmbH, Pappelallee 78/79 in 10437 Berlin. The text form according to § 126b BGB is sufficient.

Severability clause
Should any present or future provision of the contract be or become invalid/void or unenforceable in whole or in part for reasons other than 305-310 BGB, this shall not affect the validity of the remaining provisions of this contract, unless the performance of the contract constitutes an unreasonable hardship for one party. The same shall apply if a loophole requiring supplementation arises after conclusion of the contract. The respective statutory provisions shall take the place of the invalid/invalid or unenforceable provisions.
