General terms and conditions

All bookings / reservations are expressly subject to the following General Terms and Conditions of Business and Delivery:

§1 Scope of these GTC
The following general terms and conditions apply exclusively to all bookings, orders placed with us and contracts in relation to Teamevent 030 GmbH. These general terms and conditions apply exclusively to consumers, i.e. natural persons who make use of our services without this being attributable to their commercial or professional activity.

No responsibility is taken for the correctness of the data contained in the online presence and in the offer pages of Teamevent 030 GmbH.

§2. INDOOR LASERGAME

Booking enquiries, deposit, conclusion of contract

§ 2.1 Booking request and deposit
2.1.1 A message sent via the contact and booking form is considered an enquiry until Teamevent 030 GmbH confirms it in writing (by email).
A booking request is only considered confirmed when Teamevent 030 GmbH has sent a written notification (by e-mail).
If an appointment is made, there is no basic claim to exclusive use (without other groups) of our play areas. In order to enable exclusive use of one of our play arenas, we require written information in your booking request. The conditions for exclusive use are described under §2.2.

2.1.2 For bookings of groups of 10 or more participants, a deposit for at least 6 players is required. Tickets can be purchased via the online shop of Teamevent 030 GmbH. A ticket purchase can only be made after a date reservation. The respective payment link will be communicated to the customer by email (booking confirmation). Optionally, a reserved date can also be paid for in full in advance. Please note: It is essential that you state the name of the person making the booking and the date and time of the performance in the order process so that your payment can be allocated. The prepaid amount will be credited to the reserved play date and charged on site. The advance payment / deposit is not an additional fee!

Important: It is necessary that a change in the number of participants (+ or -) is communicated in advance, but at the latest 24 hours before the reserved play date, by eMail at info@underground-lasergame.de!

2.1.4 For play date reservations in the context of a stag/hen party (JGA), a deposit for at least 4 participants is required. The respective payment link will be communicated to the customer by email (booking confirmation). Optionally, full prepayment can also be made for a reserved date. Note: Please be sure to state the name of the person booking and the date and time of the game in the order process so that your payment can be allocated. The prepaid amount will be credited to the reserved play date and charged on site. The advance payment / deposit is not an additional fee!

§2.2 Exclusive use of a playing area (no other player groups):

Depending on the availability of the playing areas, we offer exclusive use (without other participants). It is important that the keyword "exclusive booking" is already noted in the booking request under "Message".

This service can be booked for an additional fee (on top of the regular game price) of only € 8.00 per participant. Prerequisite for this is a guaranteed minimum number of participants of 12 players. For exclusive bookings a deposit for 6 players is required. Tickets can be purchased via the online store of Teamevent 030 GmbH. A ticket purchase can only be made after a date reservation. The respective payment link will be communicated to the customer via eMail (booking confirmation). The prepaid amount will be credited to the reserved date and charged on site. This deposit can be made after receiving the booking confirmation (by eMail) via our OnlineShop.
Please be sure to include the name of the person booking, the play date with start time in the order process so that your payment can be allocated more quickly.

If the customer shows up for the reserved exclusive use of the gaming arena with less than 12 players, a minimum payment for 12 participants must still be made by the customer.

§2.3 Conclusion of contract
2.3.1 In principle, a contract is concluded at the venue. In principle, only the participants actually present shall be charged. Exceptions are made for exclusive bookings, company bookings with the payment option "payment by invoice" and for the offer of an underground bachelor party, including strip show.
For all other offers, the number of participants indicated by the customer in the e-form booking request is not the basis for calculation when concluding the contract on site.

2.3.2 A contract is also concluded if a partial or full payment has been made in advance for an event date confirmed in writing. A refund of advance payments is regulated in §2.3.2 ; §2.5.1 (Cancellation conditions) and in §2.5.2 and §2.5.3 (Missed appointment).

2.3.3 In the case of company reservations, a cost transfer confirmation must be signed before the reserved event date and returned to Teamevent 030 GmbH (by email or fax). The cost transfer form will be sent to the customer in advance by Teamevent 030 GmbH via email. Separate cancellation conditions apply for company bookings:

• Cancellation >/= 4 days before the event date = 0 % of the agreed costs will be charged
• Cancellation 1 - 3 days before the event date = 50 % of the agreed costs will be invoiced
• Cancellation on the agreed event day = 80% of the agreed costs will be charged

§2.4 Cancellation of appointments and missed appointments (non-appearance or lateness)

2.4.1 A cancellation on the part of the customer with an already agreed date is to be communicated to Teamevent 030 GmbH immediately (by email info@underground-lasergame.de). It is not necessary to give reasons.

In the event of a cancellation by the customer, any ticket payment already made will be refunded in accordance with the following deadlines:

• • Cancellation 5 days or more before the agreed event date = 100% of any payment already made.

• • Cancellation 3 to 4 days before the agreed event date = 60% of any payment already made

• • Cancellation 0 to 2 days before the agreed date of the event = 0% of any payment already made.

2.4.2 An appointment shall be deemed to have been missed if the agreed appointment and date confirmed in writing is not kept by the client.

2.4.3 An appointment shall also be deemed to have been missed if one or more participants of a joint booking group arrive at the venue later than the match date confirmed in writing. For technical reasons, it is not possible to join/start the game later. This circumstance will be clearly pointed out in every written booking confirmation from Underground Lasergame. The customer is requested to be at the place of performance between 5 and 10 minutes before the event. Teamevent 030 GmbH accepts no liability for any irregularities in local public transport, long-distance and regional trains, when travelling by plane or in public road traffic (e.g. traffic jams).

2.4.4 An appointment shall be deemed not to have been attended if one or more participants of a joint booking group do not observe the conditions of participation on site and are excluded from participation for reasons of safety.

2.4.5 As the use of the play area is always with several participants/groups, Teamevent 030 GmbH reserves the right to cancel appointments due to insufficient number of participants. An exclusive (sole group use of the play area) is regulated under §2.1.

§3. OUTDOOR LASERGAME (no offers in 2022)

Booking requests, conclusion of contract
(1) A message sent via the contact and booking form is considered an appointment request until Teamevent 030 GmbH confirms it in writing (by e-mail).
A booking request is only considered as confirmed when Teamevent 030 GmbH has sent a written notification (by e-mail).
If an appointment is made, there is no basic claim for an exclusive use (without other groups) on one of our playing areas. In order to claim exclusive use of one of our play areas, we require written information in your booking request ("Your message"). The conditions for exclusive use are described under §3.1.

(2) For all play dates (only outdoor laser day), tickets for at least half of the number of participants specified by the customer must be paid for in advance. Tickets can be purchased via the online shop of Teamevent 030 GmbH. A ticket purchase can only be made after a date reservation. The respective payment link will be communicated to the customer by email (booking confirmation).

(3) No guarantee is given for the correctness of the data contained in the online presence and in the offer pages of Teamevent 030 GmbH.

§ 3.1 Exclusive use of a play area (no other player groups):
Depending on the availability of the play areas, we offer exclusive use (without other participants). It is important that the keyword "exclusive booking" is already noted in the booking request, under "Message".

This service can be booked for an additional fee (on top of the regular game price) of only € 5.00 per participant. The prerequisite for this is a guaranteed minimum number of participants of at least 10 players.
Please be sure to state the name of the person booking and the date and time of the game in the order process so that your payment can be allocated more quickly.

If the customer shows up for the reserved exclusive use of the gaming area with fewer than 10 players, the customer must still make a minimum payment for 10 participants.

§ 3.2 Conclusion of contract
3.3.1 A contract is concluded for customers without an OnlineTicket at the venue. As a matter of principle, only the participants actually present shall be charged (exceptions exist for exclusive bookings and for company bookings with the payment option "per invoice").
The number of participants indicated by the customer in the eForm "Booking request" is not a basis for calculation when concluding the contract on site.

3.2.2 A contract is also concluded if a partial or full payment has been made in advance via the online shop of Teamevent 030 GmbH for an event date confirmed in writing. A refund of advance payments is regulated in §2.2.2 ; §2.4.1 (cancellation conditions) and in §2.4.2 and 2.4.3 (missed appointment).

3.2.3 For companies we offer payment by invoice. For this purpose, a cost transfer confirmation must be signed before the reserved event date and returned to Teamevent 030 GmbH (by email or fax).

§ 3.4 Cancellation of appointments and missed appointments (non-appearance or lateness)

3.4.1 A cancellation on the part of the customer with an already agreed date must be communicated to Teamevent 030 GmbH immediately (via email info@underground-lasergame.de). It is not necessary to give reasons.

The following cancellation conditions apply:

In the event of cancellation by the customer, any payment already made will be refunded in accordance with the following deadlines:

• • Cancellation 4 days or more before the agreed event date = 100% of any payment already made.

• • Cancellation 2 to 3 days before the agreed event date = 60% of any payment already made

• • Cancellation 0 to 1 day before the agreed event date = 0% of a payment already made

3.4.2 An appointment shall be deemed to have been missed if the agreed appointment confirmed in writing is not attended by the client.

3.4.3 Teamevent 030 GmbH accepts no liability for any irregularities in local public transport, long-distance and regional trains, when travelling by plane or in public road traffic (e.g. traffic jams).

3.4.4 An appointment shall be deemed not to have been attended if one or more participants of a joint booking group do not observe the conditions of participation on site and are excluded from participation for reasons of safety.

3.4.5 As the use of the play area is always with several participants/groups, Teamevent 030 GmbH reserves the right to cancel appointments due to insufficient number of participants. An exclusive (sole group use of the play area) is regulated under §2.1.

§ 3.5 Cancellation and premature abandonment of the match due to bad weather conditions

For safety reasons, an outdoor game cannot be held in very bad weather conditions. Bad weather conditions are defined as: Heavy rain, hail, storm

Each client is responsible for optimal and weatherproof game clothing. It must be expected that clothing can be damaged during outdoor lasergames. Teamevent 030 GmbH (Underground Lasergame) accepts no liability for damaged clothing.

In the event that Teamevent 030 GmbH (Underground Lasergame) has to cancel a reserved game before the actual game date, any deposit already paid will be refunded in full.

Teamevent 030 GmbH accepts no liability in the event that play dates that have already begun have to be cancelled due to very bad weather conditions. A refund of payments already made will not be made. The customer will be offered an alternative date.

§4 Right of withdrawal

Cancellation policy
The right of withdrawal is available to every consumer in the sense of § 13 BGB (German Civil Code). A consumer is a natural person who has ordered the goods for private and not for commercial or professional purposes.

Right of withdrawal
You may revoke your contractual declaration in text form (e.g. letter, e-mail) within 14 days without stating reasons. The period begins after receipt of this instruction in text form, but not before conclusion of the contract and also not before fulfilment of our information obligations according to Article 246 § 2 in connection with § 1 paragraph 1 and 2 EGBGB as well as our obligations according to § 312g paragraph 1 sentence 1 BGB in connection with Article 246 § 3 EGBGB. The timely dispatch of the revocation is sufficient to comply with the revocation period. The revocation is to be sent to:

Insofar as the voucher is valid at a precisely specified time, in particular vouchers for events with a fixed date, this does not constitute a distance contract pursuant to § 312b BGB. A right of revocation and return is excluded for these vouchers.

Consequences of revocation
In the event of an effective revocation, the services received by both parties must be returned and any benefits derived (e.g. interest) must be surrendered. If you are unable to return or surrender the received performance and benefits (e.g. advantages of use), you must compensate us for the loss in value. This may mean that you must nevertheless fulfil the contractual payment obligations for the period until revocation. Obligations to refund payments must be fulfilled within 30 days. The period begins for you with the dispatch of your notice of revocation, for us with its receipt.

Special notes
Your right of cancellation expires prematurely if the contract has been completely fulfilled by both parties at your express request before you have exercised your right of cancellation.

§5 Descriptions and details of the events

The times given with regard to the duration of the respective events are only indicative of the time you will spend in connection with the respective experience. You may spend the experiences with other participants on the corresponding event date. There may be waiting times in exceptional cases. The times given on the websites of Teamevent 030 GmbH (Underground Lasergame®) are therefore non-binding and may vary.
A game briefing and preparation is included in the booked event time!

§6 Conditions of participation

• All participants are bound by the instructions of the moderators during the entire event. These instructions must be followed at all times! Non-compliance may lead to exclusion from the event.
• Participants are prohibited from using any equipment other than that provided by the organiser or its agents.
• Participants are excluded from the event for safety reasons if they are conspicuousby alcohol, strong medication and/or intoxicating / narcotic substances!
• Participants with respiratory and/or cardiovascular diseases, can unfortunately not participate in the laser tag games.
• Each participant must behave in a way that does not endanger others
• at the indoor games, participants under 16 years of age are excluded from the event
• for the outdoor games, participants under 18 years of age are excluded from the event
• for outdoor games each customer is responsible for weatherproof clothing

§7 Exclusion conditions for participation in an event

• • the participant suffers from cardiovascular diseases

• • of the participant suffers from a respiratory disease

• • the participant suffers from epilepsy and is not undergoing medical treatment

• • the participant is intoxicated or is conspicuous in his/her actions due to other intoxicating/stupefying substances (no refund of a payment already made)

• • the participant does not follow the instructions of the moderators (no refund of any payment already made)

• • the participant endangers him/herself and/or other participants (no refund of any payment already made)

§8 Form of declarations
Legally relevant declarations and notifications that you have to make to Teamevent 030 GmbH must be made in writing and sent by post to the address Teamevent 030 GmbH, Pappelallee 78/79 in 10437 Berlin. The text form according to § 126b BGB is sufficient.

§9 Copyrights
Teamevent 030 GmbH reserves all copyrights and other rights to the service as well as the published contents, information, pictures, videos and databases (hereinafter referred to as "protected property"). Any modification, duplication, publication, transfer to third parties and/or other use of the protected property without prior written consent from Teamevent 030 GmbH is therefore expressly prohibited.

§10 Disclaimer for external links
Teamevent 030 GmbH refers on its pages with links to other pages on the internet. The following applies to all these links: Teamevent 030 GmbH expressly declares that it has no influence whatsoever on the design and content of the linked pages. Therefore, we hereby expressly dissociate ourselves from all contents of all linked pages of third parties on www.underground-lasergame.de and www.teamevent-030.de and do not adopt these contents as our own. This declaration applies to all displayed links and to all contents of the pages to which links lead.

§11 Changes to the Terms of Use
Teamevent 030 GmbH may amend these Terms of Use from time to time to implement legal requirements or to reflect changes in functionality. The current Terms of Use can be found at https://www.underground-lasergame.de/agb/. If you do not agree with the amended terms of use, you will unfortunately no longer be able to use our service. As far as a contractual relationship has already been established between Teamevent 030 GmbH and the customer, the changed terms of use only apply if the customer has been informed of the change by Teamevent 030 GmbH, he has not objected to the validity of the changed terms of use within 6 weeks in writing or in text form to Teamevent 030 GmbH and he has been pointed out to the legal consequences of an omitted objection with the notification.

§12 Final clauses
(1) The law of the Federal Republic of Germany shall apply exclusively.
(2) The sole place of performance for delivery, service and payment is Berlin, insofar as the customer is an entrepreneur within the meaning of § 14 BGB.
(3) If the customer is a merchant, the exclusive (also international) place of jurisdiction for all disputes arising directly or indirectly from the contractual relationship shall be Berlin. This also applies to non-merchants in the case of cross-border contracts. Teamevent 030 GmbH reserves the right to invoke any other internationally competent court.

Severability clause
Should any present or future provision of the contract be or become invalid/void or unenforceable in whole or in part for reasons other than 305-310 BGB, this shall not affect the validity of the remaining provisions of this contract, unless the performance of the contract constitutes an unreasonable hardship for one party. The same shall apply if a loophole requiring supplementation arises after conclusion of the contract. The respective statutory provisions shall take the place of the invalid/invalid or unenforceable provisions.
